The first post contents sound like communist state powers, not a democracy. I believe these would only be used in a state of emergency.

The second post contents just illustrates the knee-jerk reaction to the 9/11 events in respect to "terrorists" only.

Geez, any Government that DIDN'T have the power to do the things outlined in the first post would be insanely lax. Such emergency powers have to exist.

While it is the responsability of the government to step in and take control in an emergency situation, it is also the responsability of the government not to be the cause of the emergency situation.
