ummm

using pictures of comic book characters in your avatar or sig is also illegal for the same reasons

fansites/KMC = copyright distribution infringement

Technically fan-made images of characters are only illegal if you are making a profit off said character's image and whoever made the character sees no profit (which is why fansites are everywhere).

yup, fan made, hence, if you draw the image

in fact, you can draw a copywrited figure and sell the origional of it, but if you sell a copy you are illegally distributing an intellectual property

however, most of the fansites dont create their own images, they are comprised of copywrited images taken from books, magazines, posters, ect

think about it, who profits from torrent or pirated material? There is no money being made, so by your definition it is not illegal.

The law is about the right to be the sole distributer of a copywrited property, not a cbr file, not a fansite, not an avatar. Basically, if you copywrite something, you get to say who gets to use it or doesn't.

Marvel doesnt crack down on sites simply because it isnt in their interest to destroy free promotional services.
