Never let anyone else define you. Don't be a jerk just to be a jerk, but if you are expressing your true inner feelings and beliefs, or at least trying to express that inner child, and everyone gets pissed off about it, never NEVER apologize for it. Let them think what they want, let them define you in their narrow little minds while they suppress every last piece of them just to keep a friend that never liked them for themselves in the first place.
Not saying he doesn't win for the reasons you state, but anybody that could give Cap a good fight (Not to mention the Iron Fist!) is formidable, in my book.
Edit: Heh, speaking of Cap, this quote comes to mind: "I've never beaten Cap, but I've fought him. And that's as good as you're going to get, because no one beats Captain America."
Little bit of grumbling from the writer on Marvel policy, I'm thinking.
But it's true, no one beats Cap in Marvel. The fact Batroc consistently makes a fight of it is as impressive as it gets.

Lol cant argue with that. Best part, all of Marvel's writers seem to think that. I love Slott's run on Spider-man and web-head is very formidable in it, yet keeps struggling with Cap America of all people. And the two times SpOck fought the Avengers its always Steve who lands the victory hit.
But yeah, I do believe SS wins this, would be a better fight without the sword.
