Woman forced to marry at 15

This woman was forced to marry a man who raped her every day. Could this ever happen legally in America where someone if forced to be with someone they don't want to be with?

And to expand a bit, say a person doesn't want to be with someone can the government in America force those people to be together.

If so, I can't see it getting very far in court, would likely be thrown out.

Let's break this down:



1. Cultural Superiority and Judgementalism:

Let's keep in mind that we do not have to go back but a few decades where our great grandparents routinely got married at 14-15. America is not this great bastion of good and righteousness and we do not get to sit on our pedestals judging other cultures.

My great grandmother was married at 14 with her first child at 15. Her husband was 17 when they got married.

It was normal, then. And they stayed married, had tons of kids, lots of grand children, etc. They loved each other and they were happy.

The difference is they chose each other.

This lady in the article didn't get a choice.


2. Rape
I take issue with her claiming she was raped every night. She admitted that her husband was kind and accommodating to her but that he raped her every night. She also said she didn't complain or say anything about it. What she really means is that she thinks arranged marriages result in rape because the two people did not choose each other. This situation does not fall under the 4 categories of rape. But I understand that many modern feminists want to classify rape into 5 categories with arranged marriages being the 5th. I disagree with arranged marriages but I do not go as far as to claim they are rape. Perhaps it would be better to say it is the families forcing two of their children into a marriage. Calling it rape is disingenuous, manipulative, and dishonest.

What about the expectation from the husband that he get her pregnant? He is performing his duties. Doesn't that mean it was rape for him as well? They were both expected to get married and make babies. And finding the birth control? That was probably the mother-in-law, an aunt, or even her own family. Notice she did not mention it was her husband.

But wait...secretly being on birth control? Now this does classify as the 4th category of rape. She raped her husband because he was having sex with her under the impression that it was to get her pregnant. He entered into a sexual agreement with false information. He could not give informed consent to the sex. Therefore, she raped him.

For those of you scoffing at this idea, the 4th category of rape was codified into law in CA, indirectly, with HIV. If you did not disclose you had HIV and then had sex, that was a crime. A rape victim cannot give informed consent. They removed this law, however. But that should give you an idea of why the 4th category of rape is important: informed consent is important.


3. Virus and Baby
And her husband gave her CMV? She said a virus was passed to her from her husband and then from her to the baby. That sounds like CMV. An infection vector for that is hard to tell: she could have given it to the baby and her husband had nothing to do with that. She could have infected her husband.



Just because a woman cries about a baby in an interview does not mean you should go straight to an emotional reaction. Don't let the manipulation from the "cause" influence your ability to think through these situations.


How old was he when he was put into that arranged marriage? Where is the interview with him? Follow-up questions? This is journalism 101. Clearly, they are not following the standard template for journalism for a reason.
