One thinks that he was technically conscious during the time of the killing but may not have realised what he had done until after.
The other thinks it was because of sleepwalking, which is not an illness of the brain.
And the third's the accused's mommy, but she's not nearly as important as the two neurologist specialists.
I've been under extreme emotional stress, unable to sleep more than four hours for months, and drinking like a fish and I never woke up choking people to death.
Hey, the neurologist says it's pretty likely; the perp was a routine sleepwalker and drinking may have influenced his subconscious mind. Not to mention he was really hard to rouse.
One or two people probably got off of murder because of this.
I'd get a second opinion. For one thing, we don't traditionally let people off for killing under the influence, that's still manslaughter 1, last I checked. Something like 6-12 years, minimum. And in order to successfully argue sleepwalking under the influence of alcohol, they'd have to establish that the perp was -indeed- sleepwalking. Alcohol should be pretty evident at this point.
And really, do you know how long it takes to choke someone to death? Unless he had her in the sleeper hold, that had to take a few good minutes.

Neurologists did tests on him and they established that he was sleepwalking, they were skeptical of it at first as well, like you were.
And you can't be guilty of a criminal offense if you can't control your actions at the time, as this Mr. Hudson dude was. He can't have developed any premeditation either, he was cool with them and the subconscious mind really differs from the conscious.
