Such as is a relative term, he could mean every villain in every X-Movie, he used Brotherhood because they were what came to mind when you thought of villains in the X-Men movies. Who were really villains in HP besides the Death Eaters?

Magneto did team with Xavier, have you seen the second movie? He doesn't even hate Charles, he threatened Pyro when he said he would kill Charles. They are still good friends.

Actually no. It's clearly stated in the movei that the phoenix is merely an alter ego, albeit an evil powerfull one. It negates the comic version completely. When a movie does that you can only say it's loosley based. If the phoenix had been the super pwnage cosmic entitiy from the comics then fine, but she wasn't.
