Danny just fought with a broken back, and had some really nice durability feats. Better odds of surviving then Spidey at this point.

I don't dispute thaf, but he still had/has a broken back. Confirned in the next issue, where nurse what's her name checks him and confirms it's still broken.

A fact Bendis either forgot, or downplayed for drama.
He was saying "owie" and everything while the nurse prodded him and told him his back was broken.. (He did heal up enough to join Matt later, but this was well after the rematch with Cottonmouth..)
