I think theres a way around that. Not exactly a loophole, but some degree of reasoning thats applied.

Just an example-
We don't want musical keys A,B,C owned by AOL and everytime someone wants to play a song they avhe to consult AOL or some bs like that.

If the soundtrack is copyrighted as a whole, then all the content therein is copyrighted.
The exception

But some segments can be used from the soundtrack, as long as those particular segments are'nt copyrighted. Such as THX soundeffects.

"Fair use provisions of the copyright law allow for limited copying or distribution of published works without the author's permission in some cases. Examples of fair use of copyrighted materials include quotation of excerpts in a review or critique, or copying of a small part of a work by a teacher or student to illustrate a lesson."

As far as I know, this can be applied to silly little gifs too. Even if the work was obtained through, very illegal means.
