You failed to mention the next page which clearly shows Kal being pissed off and greatly annoyed with CM. He was clearly holding back.

the next page shows Superman manhandling Billy.... not Marvel.... (that's why i left it out).... he was lucky to get a shot at Billy.... had Marvel decided to kill him after that last scan he wouldn't have had much trouble

Well after browsing my copy of the issue I come to the conclusion that Captain Marvel uses his wisdom of Soloman quite wisely in that issue.
He outsmarted Batman with it.
