Silver Surfer would still pose a problem. He was able to resist Moondragon & the Mind Gem so he would probably resist Xavier as well.

Gladiator, on the other hand, is vulnerable to Xavier-like TP, as demonstrated by Cassandra Nova. Come to think of it, if Xavier managed to turn Gladiator against Surfer it might give the Council the edge in this fight.
