*Battle 1 takes place in the real world (Smith still has his superhuman abilities( Hand to Hand only

*Battle 2 Takes place in the Matrix Agent Smith is allowed 2 clones, but Khan gets both guns that he used against that Klingon Squad

Khan is more at a Trinity level, whereas Agent Smith was able to dominate her (and her superior, Morpheus) pretty solidly. Smith should take out Khan without That much trouble.
