H2H only, Surfer cannot use his PC at all other than to enhance his strength and durability, who wins?

So if he got close to Herc, could he smack him around like he did Beta Ray bill in close combat? Granted, Silver Surfer's fists were glowy. But is that against the rules of the thread?

No use of the PC other than increasing his strength and durability.
