Like X said her phasing does actually offer her some sort of protection. But Emma can still mind rape her. And did actually mind rape her afterwards.
It's sort of hard to explain. Emma's little imaginary Hellfire Club planned it that way. Well once you understand the whole story it's sort of self sabotage.
The real Emma Frost persona was becoming too volatile, her survivors guilt has driven her insane(Well more insane then usual). Her love for Scott was beginning to show and that persona would have compromised the Hellfire Clubs Nova mission.
During Morrisons New X-Men Run, Emma tricked and trapped Cassandra Nova in a metamorphs body.
What has now been revealed is that right before this event occured, Nova left a psychic imprint at the back of Emma's mind. A tiny/suggestion imprint that amplified Emma's greatest weakness - Her Survivors Guilt. It's explained in the following scans:
By allowing Kitty to trap Emma Frost underground the White Queen(Emma's other persona) and Nova would have eliminated any last minute heroics from "good" Emma. And the Real Emma's instability factor/Guilt would have contributed to making this event happen.
