Juggernaut doesnt have a mutant gene he has magical powers. Well anybody with a mutnat gene is a bit too broad now.....that means I could be anybody with superhuman powers eg The Leader. Its best to keep it to people born with mutant powers.

You see, I never really got that. Like in Marvel when everyone singles out the homosuperiors as mutants. When in actuality, pretty much all the heros with powers are mutants. Unless they have tech or magic based powers but, like Spiderman, Cap, Luke Cage, Daredevil, The Fantastic Four, the Sentry, and even the Inhumans are technicly mutants to right?

Considered but isn't, he doesn't have the x-gene. In one episode of Spider-Man and his Amazing Friends, Firestar and Iceman went to a reunion of X-Men and told Spidey that he couldn’t come because one he wasn’t a former X-Man or a mutant.
As for the baseline humans they are the same but they technically are not in the MU.
it alter yes, but to be a mutant you need a sort of x-gene and you need the ability to evolve. capt dna is not truely mutated and he can no evolve same with the rest of the people you mention. Spiderman the only person who dna can evolve

I wouldn't allow Spiderman, he isn't as close to mutants as like Juggernaut. He did mutate, but does not have a mutant gene. If i allowed someone who had mutated, most heroes and villians may be allowed.
