They didnt lost the sue tho. Captain Marvel stop being published by that company when Superheroes in a general rule, werent making any profit. Especially by a company who wasent a big one like DC and its associates.
DC only bought the caracter later (during the 70`s i think). Together with some others of other small companies.
At least its what ive read before about the case.
