In cases where direct proof is not made possible, such as in courts of law, a logical assumption must be made with what is already evident. In this case, we know that Nihilus feeds off of force sensitives. If a Jedi was a meal, Vader would be a friggin' buffet. Vader has no realistic defense against Nihilus' abilities. Thus, he loses.
