The Integrity of Mist's Ban?

I will not mention the name of the Member whom had sent me the PM, but from the PM I have stored in my Inbox, he sends me a message, repulsively swearing in it and insulting me and it ends with a picture of a naked man shoving his middle finger into private regions . . .
I sent a picture of this PM to Raz, and the Administrator replied with the quoted post above.
If they cannot interfere with situations that occur during a PM, then why are they doing it right now?
Why should the rules be bent this time, and stay straight in an occasion similar to this?

^ This is what I understand happened with Mist.
The Member that sent me the PM with the Graphic Image and the consistent cussing was previously warned in the past and Raz states that nothing can be done to him because this was something that happened during Private Messaging, which Mods and even the ADMIN cannot step into.
So, why are the Rules different in this scenario?
