He did appoint someone. Issue is, Congress is majority Republican, and they're the ones who get to approve or deny Obama's selection. Even though Obama tried to find common ground and appointed a pretty neutral democrat, the Republican party has already decided to oppose anyone who Obama selects because of how close it is to the end of his term.
