OMFG! LOLZ! Da Trolls got PWNED!!

Okay, let me clarify something. Yes, I'm guilty of making a silly stupid title to post this news article. For that I apologize. But I'm hoping there is a lesson to be learn from this article. Insulting people online or trying to belittle or provoke other people goes nowhere. In this particular case someone got into trouble.

Weston woman wins $11.3 million in defamation lawsuit over Internet postings

A Broward County jury has awarded a Weston woman $11.3 million in an Internet defamation lawsuit that legal experts say could spur more courtroom battles over what's said online.

Sue Scheff filed the lawsuit against Carey Bock in December 2003, after the Louisiana woman called her a "crook," "con artist" and "fraud" on an Internet message board for parents interested in alternative schools for troubled teens.

One message landed on the Broward County PTA Web site, calling Scheff's referral company for such parents "an old, old scam."

Legal experts say the Sept. 19 jury award may encourage more Internet-related lawsuits, particularly as message boards, blogs and social networking sites proliferate. Of the $11.3 million, almost half was awarded as punitive damages.

"I think when people read about litigation and big awards, there is sometimes an inspiring effect and others seek to imitate that success," said Sandra S. Baron, executive director of Media Law Resource Center in New York City.

But legal analysts warned that prospective plaintiffs shouldn't expect similar large awards, because of the circumstances surrounding Scheff's trial. Bock never showed up, meaning no defense was presented to the jury.

"Having a freakish [award] number where the defendant is not really represented well or at all in front of the jury happens all the time," said Robert Rivas, a Tallahassee-based media lawyer of the Boca Raton law firm Sachs, Sax & Klein.

Scheff's attorney David Pollack, however, said he believes the jury award sends the message that those committing defamation or libel over the Internet cannot escape responsibility for their actions.

"What this verdict says is you can't go and destroy someone's reputation and post defamatory statements about them over the Internet. It's something that hundreds and thousands of people can see and you can't get away with it. That's the bottom line," he said.

Many victims of Internet chatter have already stepped into the courtroom on defamation or libel claims. More than 50 lawsuits have been filed across the country against bloggers alone, according to the Media Law Resource Center. Seven of those cases were filed in Florida, and most are still pending.

Pollack said that since the verdict, he has already received phone calls from potential clients.

"The real problem with these cases, for the people who are the victims of this defamation, [is] you can basically with the click of a mouse, destroy somebody's reputation, their business, their livelihood, their family with absolutely no justification," he said.

In her postings, Bock accused Scheff and her company, Parents Universal Resource Experts, of placing children in "risky" and "possibly abusive" programs. Scheff's firm provides parents a list of alternative schools and programs dedicated to troubled teens.

Bock had used Scheff's services, however, to help remove her two sons from Dundee Ranch Academy, an alternative school in Costa Rica. The relationship between the two women soured, court papers show, because Bock believed Scheff was hindering her ability to land a documentary movie deal about the school.

Bock could not be reached for comment.

Pollack is investigating whether his client can actually collect the award from Bock, though he is doubtful she has $11.3 million. Scheff said if she does receive the money, she would continue her work and probably share her wealth with friends who need it -- after she pays her lawyer.

a public forum is the equivalent to a public conversation, not a publication

this means that laws are shifting in a way that you can be tried and convicted for libel with an outragious fine in a kangaroo court because of an opinion stated in a public forum, as if it were printed as fact in a publication.

though this woman crossed the line with baseless accusations, the slope is slippery. what if i jokingly said "george lucas wants to mug every one of his fans and steal all their cash" and......well....libel lawsuit

Frivolous bullsh!t lawsuits like this are part of this countries problem... "Waa, I was insulted in a chat room, waaaaa!" Give me a F'ing break, I bet the judge is a far left liberal P.O.S. that needs to retire. This one lawsuit will open Pandora's Box you will see, we will have an infestation of pathetic people sueing for having their feelings hurt online.

However there are lawsuits for deformation of character and many have won so attacking someone on a public forum could result in a lawsuit, a site like KMC isn’t really subject to this because it’s more of a general topic forum but public forums that are more specific could be.

It’s not really the judge’s fault but the jury and the lawyers for making the case and the jury for awarding the money.

Yet the obvious remains...why insult people online? What do you get out of it? Nothing.

Disagreements always happen. Nothing wrong with that...but to take it to the insultive/foul/offensive extreme is really not necessary. Keep in mind most chat rooms and message boards have rules on member treatment. Harrasment or personal attacks are never accepted.

I did... A moderate to a middle of the road liberal judge or a conservative to a far religious wack-job conservative judge would have probably thrown the case out and it never would have gone to trial, let alone have the plantiff be rewarded with 11 million.

Very rarely do any judges throw out a case, if it has any merit at all and the lawyers argue it well it will go to trial.

And that's the reason why we have so many frivolous B.S. lawsuits infecting this land. People sue over anything these days. Every once in awhile we do hear about a judge throwing out a craptastic lawsuit and I applaud the judge for it.

It’s not that they can’t but they have to abide by the law, if a case has any merit then they can’t simply throw it out because they think it dumb or a waist of the courts time. I would be dangerous if judges dismissed cases based on their own personal feelings, just as it would stop bad ones it would also stop some good ones as well.

And this is without a dobut the most idiotic lawsuit I heard about in the last three days...

What the hell, you shouldn't be able to sue people for something they said online. I could say a billion things here and be sued for them which makes no sense and is just wrong... Then again I live in another country so good luck with that, but not the point. These lawsuits are bullshit and if those whiny bastards whine then it just shows that the members of the jury were idiots...

If someone posts that you have sex with kids and others believe it and it spreads and now people believe that you do, why you shouldn’t be able to sue them for deformation of character. The same would apply to running a TV or newspaper ad that says you are a crook, what is the difference if the damage is still done.

If somebody were to post that on an online message board or in a chatroom then it would be bullshit if I could sue them, because a billion things are said in those places.

If someone were to create a site about it, advertise it and all of that crap then it would be different...
