From what I can see, there is no rule that says that either one of you is entitled to say the tracker is yours and shut down any reply to that.
So you can fight until one of you yields or have it go on forever. Regardless, as far as any rules go, you cannot overrule the other.
Of course, it would be much better if you played to the spirit of the game and worked these things out rather than bickering.
