Well Thor isn't holding back anymore according th him, surfer's jobbering has been released by galactus and superman always grows in power. how can they stay in the same tier all of the time? Of course you know i've always thought the never best GL's were above the top tier as well. 🙂

Because the ones we have in trans are just so far above the high heralds, it's not even comparable. It also seems that SS has been restored to his original levels, and Thor not holding back doesn't equal Thor with an upgrade.

Meaning that just because the votes are about even, it doesn't make him controversial, and the voting even doesn't mean he should stay off the list (even if he's losing).
