U.S. Supreme Court rules against student free speech
Morse v. Frederick. It was a 5-4 decision, which is becoming characteristic of this court (so much for consensus, huh, Roberts?). If any of you guys remember the Alaska student that was suspended from school in 2002 for holding up a sign that read "Bong Hits 4 Jesus" while the Olympic torch was passing through...
Well the Supreme Court ruled in favor of the school board (after the 9th District Court of Appeals ruled unanimously in favor of the student, no less), stating that even though the incident occurred outside of the school, it was a school-sponsored event and therefore qualified as school speech, and since it "promoted" the use of illegal drugs, it was not constitutionally protected speech.
Clarence Thomas wrote a dangerous concurring opinion that students had no free speech whatsoever. How did he get to the Supreme Court, exactly?
Can't wait until 2009...maybe Scalia will die and we'll get a Justice who actually respects the Constitution.
