How? Rape usually implies somebody forcefully penetrating somebody else without that persons permission. The dead person couldn't possibly refuse. So not rape.
And there are many ways to NOT GIVE PERMISSION which don't involve verbally refusing.

The definition of Rape according to websters
"unlawful sexual activity and usually sexual intercourse carried out forcibly or under threat of injury against the will usually of a female or with a person who is beneath a certain age or incapable of valid consent -- compare SEXUAL ASSAULT, STATUTORY RAPE"
Against the will being the key words there, she's dead she has no will.
The use law has the following to say about this
Section 2241. Aggravated sexual abuse (1/5/99)
(a) By Force or Threat. - Whoever, in the special maritime and territorial jurisdiction of the
United States or in a Federal prison, knowingly causes another person to engage in a sexual act -
(1) by using force against that other person; or
(2) by threatening or placing that other person in fear that any person will be subjected to
death, serious bodily injury, or kidnapping; or attempts to do so, shall be fined under this title,
imprisoned for any term of years or life, or both.
(b) By Other Means. - Whoever, in the special maritime and territorial jurisdiction of the

All require the victim to be alive, she wasn't. Ergo not rape.
