Thanos had no way of budging Odin and struggled to stand up.
He later referred to it as a defeat.
Ergo, it was a loss.
But okay, let's call it "the fight reached a point where Odin found a reason to stop and Thanos had not yet scratched him, but did not want to give up despite barely being able to stand"

Odin thought he killed Thanos and when he realized he hadnt gave him a chance to yield. Earlier in the battle he admitted he was going to kill him.
