the boys who did this were obviously chavs, hate emos, listening to hardcore DJ's and wearing hoodies and joggers, its sad that stereotyping is such a big thing, people get killed about it. if my mates see someone wearing long black leather coat, they start shouting at the perso, "EMO", "GO CUT YOUR WRISTS" etc. hopefully the chav-emo fad will die out soon.

I'm with Backfire. (Drunk post?) Here's how I'm interpreting your post:1. Children, despite being underage, are placed in an adult prison and thus raped by adults. Since children are less likely to be raped by adults in a non-adult prison, they should not be placed into adult prisons. (The "don't realize they're being raped as adults" was very black sarcasm, yes?)
2. There are two main points-of-view on these types of cases. A: The child's crime was so awful that he or she should be tried as an adult because, in a sense, only an adult could have committed such a horrific crime. B: The child is likely to continue exhibiting such behavior in the future because the child is so corrupted.
3. Let's think about this: we try these kids as adults but there are many children who are committing these same crimes. This does not indicate that these children have the mental capacity of adults to commit these crimes, but rather it indicates that these crimes ought not to automatically categorize the children as "adults" (in terms of being tried).
4. How can we truly classify these children as adults or children when they are barely pubescent?
Other than that, you're going to have to clarify.
No, I wasn't drunk. All of those points apply. However, number four most of all. Often times we determine the punishment because of mitigating circumstances, such as age, retardation, mental health, intent, etc. But we determine all that because of how we feel about the crime, how we wrap our minds around what happened and what it would take for us to do such a thing. And in this case, to try them as adults is to assume a child wouldn't stomp in the skull of a girl. Well, if an adult had done this, people woud be calling him evil because he stomped in the girls skull, after or as a means off killing her, and we'd be questioning his sanity.
And the point about the kid being raped refers to the fact that I seriously doubt the kid is thinking about being a kid while he's being raped.

I thought that if you are tried as an adult when still a "child", if you are found guilty, you serve time in a juvenile facility until you are 18. When you are 18, you are transferred to "adult prison".
Can someone confirm this?
