When I said he could have it I meant have it as an avatar should I leave or get banned. Anyone can easily just copy and paste my avatar or a what you have just posted, but they can't have the same avatar as me since that would result in a ban or a warning not sure which, but it's just like if someone copied someone else's sig. So while I am here it's my avatar for everyone to enjoy but not to use as their own.

I agree that it isn't proper to have the same avatar as someone else.
However, if you had the time to look through all the user accounts here, you could find that many many members here have the same avatar.
