I dunno, I'm sure it's been suggested plenty of times already that he might meet the same fate he did in the Knightfall arc. But without the lazarus pit they'd either have to do a huge time skip or have him out of commission through a lot of the movie. Though I think they could definitely still have a great movie with Batman out of the game for awhile.
