I'd say so. The Mask made references to thing's he'd done in past issues.

which comic company has the license over the mask character ?

i see it mostly in dark horse comics but also the mask has appeared in DC and marvel comics as well.

in the movies they make it sound like its more a marvel character with the story that the mask belonged to loki

The Mask is a Dark Horse character - always has been. His only appearances alongside Marvel/DC characters occur in crossovers. He has nothing to do with those companies aside from that.

^ There are none. For some reason I had it in my mind that Marshal Law was a Marvel character -- but he's from EPIC. So yeah, Mask has only appeared alongside DC and miscellaneous Indie characters.
