Death penalty in Gotham

What if Gotham had a death penalty on criminals, what do you think would happen to the batman?

I always thought that Gotham did, but the major criminals (Joker, Two-Face, Scarecrow, etc.) plead insanity, and the gangsters have ways of getting out of it...

I doubt there is... Besides Batman or any other hero in Gotham would not exist

theres still a warrant for batmans arrest every day for someone who takes the law into their own hands. the problem is they cant catch him.
