Humans, like creatures, are all different one way or another. Generalizing us as selfish or selfless only works for some of our race. I've met some nice people who care about all creatures, and I've met heartless people who only care about themselves. Same goes for the whale. There are some killer whales that are peaceful and loving, while others are violent and dangerous.
That's kinda what I meant. We at least have the capabilities to consider such matter and perhaps decide. Most animals are in many ways fully tied to their instincts, which often would be considered most selfish.
As for the whale killing people, it wasn't clarified too much in the stories I read, but it was somewhat implied that he didn't maliciously kill people, like he didn't eat them or anything, but rather that he was "playing". About the first incident in the nineties I have heard nothing except for "he was linked to an incident", the second was a guy who snug into his tank and apparently was held under water while trying to swim with the whale, though honestly, how would the whale know that a guy needs to breath every minute...
