^ Pretty sure Marvel MAX imprint makes it not 616 unless specifically retconned in, aka, Alias and Jessica Jones. Frankly, the violence itself made it clear to me. It was a three day siege on Manhattan where thousands of New Yorkers are brutally killed/raped, along with hundreds of Marines dead, along with the ravaging of Manhattan itself, and the Mayor himself getting speared in the head.

Then you got Dr. Strange's really odd behavior, and the Avengers are wearing outdated costumes. The setting was 2003, and Ironman was in his original red/gold armor. I thought it was pretty obvious it wasn't 616. No?
