who wins ?

Shaw wins. IMO I think that shaw can tank everything Sinsiter can dish out unless he has some impressive mind intrusion move I am unaware of. Shaw will absorb it all and beat sinsiter down to mush until it counts as a KO.

Not sure about what possible TP resistance feats Shaw may have. Mindrape is probably Sinister's best option, but if Shaw's shown some resistance, Essex is screwed.

He has TP resistant tech. If he has it he's good.

Shaw for a majority (Sinister can still pull some wins). He's shown he has SOME TP resist when he fought Emma Frost.

In all seriousness though, Shaw can do it. IMHO he can resist the mindrape long enough to pummel Sinister.

there's also a nice scan of him with a big smile on his face after almost getting severed in two by cyclops' optic blast (which i can't remember which issue it's in). didn't seem to bother him at all

The best way to beat shaw would be via erecting a forcefield (or just staying airborne) and shutting down his mind. His natural TP resistance is not good enough to withstand a prolonged assault. Maybe if he had those shields or whatever it was that prevented Xavier from affecting him (Legacy series)...

Shaw can't put Essex down. Sinister on the other hand can defeat Sebastian quite easily... even without his TP he could think of some way.

Sinister seems to be pretty underrated on this forum in general.
