Mass Shooting in Colorado

In order to get the attempted murder charge, you actually have to take some actions that shows you attempted murder. Words alone do not constitute attempted murder. So, in court, the prosecutor would have to demonstrate that you made a physical attempt to murder. That could be collecting materials to do it, typing up plans, writing down plans, etc. Stuff like that.

driving with the gun in his car on the way to, admittedly, kill his boss?

maybe I'm remembering wrong, wasn't he caught, like, "in the act" so to speak?

WTF? That's what you're talking about? Yes...**** yes...that's attempted murder. How the hell is he not getting the AM charge?

I thought so.

maybe we are thinking of a different incident than Ascendency...

alright, so Neil Prescott, the guy in Maryland who called and threatened to blow up his work, was subsequently charged with misdemeanor "telephone shenanigans", a law which the state's attorney will lobby to have strengthened, as there are no felony charges for uttering threats over the phone in Maryland. He is currently undergoing psychiatric evaluation and will not have his firearms returned if he is forced to stay in a psychiatric institution for over 30 days or if he is convicted. This seems to be more of an issue with there being no specific law about phone-threats in Maryland than anything else.

Timothy Courtois, who was arrested in Maine with the Ak-47 in his car while going 112 mph has been charged:

He has been charged with one count of making a false statement in connection with the acquisition of a firearm and two counts of possession of firearms by an unlawful user of controlled substances. He faces a maximum of 10 years in prison and a $250,000 fine.

And is expected to appear in court on August 23rd. He has just been ordered to undergo a psychiatric evaluation.

Those were the only two major cases I could think of, I thought Ascendency was talking about Courtois, but they might have meant Prescott. Either way, it doesn't look like either of these individuals are going to walk, or get their guns back.

Yeah, I was talking about Prescott. Intitially they said that they would be filing no charges and that there was no type of psych hold being planned. Glad to see that something is happening to both. Prescott will be able to acquire weapons again if he only gets convicted of a misdemeanor though. As of now he could be institutionalized for any amount of time and still be golden on buying new weapons so long as he doesn't get convicted of a felony.

the state's attounrey says that if he spends 30 days in an institution due to mental illness he will not be allowed to have his weapons back.

There's obviously an issue with the felony condition for gun control--namely that some felony crimes don't portend future homocide with firearms.

I got that part, I'm saying that in the future he will be able to acquire new weapons.

or even just how variable different felony laws are from state to state...

they don't do psych background checks in Maryland?

There's a mental health crisis in America, mix that this easy access to high powered weaponry and you're asking for trouble.

I donb't know of any states off-hand that include mental health history in background checks for weapon purchases. Only felonies disqualify you.

As true about this incident as it was about Virginia Tech (what it was written about).

Lead singer of Megadeth Dave Mustaine believes Obama did it: http://www.tmz.com/2012/08/15/megadeth-singer-obama-staged-aurora-shooting-massacre/, besides being a Nazi and born in Kenya.

Well, that's all it took for me to believe: the endorsement of that theory by a Megadeath band member.

The lead singer, bro. That's like a +2.

My favorite was the: "And you see the signs in Kenya that say 'the birthplace of Barack Obama.' Hello?! C'mon, guys. How stupid are we right now?"

Because it would have killed Mustaine to do two minutes of research on the internet.

I don't even know what to say to that. I have enjoyed Megadeth for years and never seen hints that Mustane was so utterly off the deep end. He slayed at Musical Jeopardy but clearly everything is not alright upstairs. Wow.

the snopes article on it is amazing, and the fake signs are terrible

If you can read Arabic text (which isn't even the national language of Kenya anyways), the words are backward and the letters don't connect to eachother the way they should... its a really, really sloppy fake...

edit:

just to be a pedant:

the part on the sign highlighted in red is how they have spelled Barak Obama, the terrible MS paint script under it is how those letters should be written [the sign also reads left to right, the script should be written right to left, as it is in the MS paint text]. I'd also argue that the "Alif" (the straight vertical line, makes a strong A sound) isn't appropriate for how Barak Obama is phonetically pronounced, and the "Alif+Waw" (the one that kind of looks like a "9"😉 at the beginning of Obama should be an "Alif" with a "Waw" accent, not two separate letters.

imho at least, I only know a little arabic, maybe they did get something right... but I don't think so. The second "a" in Barak is, for sure, not an "Alif", nor should the first be.

Mustaine is going to get out of this by claiming that he didn't say this and that it was just one of his other "me's" from that music video.
