Wrong again. Clearly this is a concept too difficult for you to grasp so allow me to try to help you. By allowing someone to borrow something of yours that something would still be your property. The bag o weed was removed from you and is now the property of the police department. Do you follow so far? Ok next we have me going to you offering to steal it from the legal owners of the bag and to give it to you. Then i keep it for myself. I have stolen it not from you but from the rightful owners of it which would be the PD. Then i simply did not give it to you but since you are no longer the rightful owner of it i have only lied to you

If you stole it to gave it back to the original owner you lied and stole it from him. Agreeing to give it back to its owner your acknowledge makes it theft.
