Potter-world spell casting, especially in combat, is usually point and click, meaning they can be dodged and evaded. Khan is fast and agile, not to mention smart enough, to do so, and the terrain here should provide some nice cover, and allot Khan to stalk Harry more effectively than the reverse. Id take Khan here a little bit more than not.

Harry can turn Khan's guns into tin cans with a flick of the wrist.

Khan can annihilate him by moving his finger. Harry starts out in the open and can is a lot faster than Harry. Even if Harry used a spell Khan could dodge it, but Harry can't dodge khans weapons.
