Because if we are talking about a fight between Gladiator vs Superman has they are shown normally then the killer Instinct should be counted. If Gladiator is easily able to come to grips with killing then he is going to go for it faster then Superman which is why I think in a fight Gladiator has somewhat of an edge.

So, basically, the scenario means one of them HAS to die, which means at some point Superman will end-up killing if that's what's required to live. Considering all the opponents he's beaten who were trying to kill him.
Unless, you're basically saying Superman won't kill, which means you've decided ahead of time he won't win. So, what exactly is going to happen? Gladiator's not going to kill Superman considering the more powerful, more brutal opponents Superman's faced without resorting to killing. Is it just going to be a stalemate of Gladiator keeps getting his ass kicked but Superman won't kill him? 'Cuz I'm not seeing Gladiator winning this even if Superman refuses to kill.
