The reporter is saying that it's illegal to store the emails, and he's technically correct. It is illegal to store classified information on an unauthorized private server—but mass media corporations are not exempt to this, like the reporter implied—it is however not illegal to access them.

Podesta's email were not classified. Nor were they secure.
