"H.R. 985, the Fairness in Class Action Litigation Act is akin to an Erin Brockovich killer. The first of the two laws, would make it more difficult for American’s to file class action lawsuits against a corporation, the Center for American Progress explains. The law would put restrictions on the criteria for people banding together for a class action suit. It also would complicate and delay any payments for an attorney representing the clients. Such an act would make it risky for any lawyer to take on a case to help someone hurt by a corporation. According to CAP, Vice President Mike Pence has been seeking laws like this for years."

In essence, Republican are making it virtually impossible for anyone to sue large corporations for harming their employees and making it severely risky for a lawyer to represent them.

Discuss.

Wow.

so corporations would have the rights of people, but people won't.
good job republicans. 👆 how does satan's cock taste?

I'd be curious as to how they justify this law?

I more curious as to how much of a twist is being put on this from the sources that Neph pulled this from.

Yeah, I'm not a lawyer so when it is said they are making it "more difficult" I don't even know what that specifically entails.

Though speaking of Erin Brockovich lol read #6:

6 'Based on a True Story' Movies with Unpleasant Epilogues

She kinda sounds like a kunt.

The justification is that there's too many "frivolous" lawsuits that harm company's financially.

The lawyer thing is this:

"H.R. 720 the Lawsuit Abuse Reduction Act would require federal judges penalize or otherwise discipline any attorney that brings what they consider to be a “frivolous lawsuit.” Currently, this decision is left up to the judge’s discretion."

As well as making it harder for those lawyers to get paid.

So hold on, under this new act..who gets to now decide what a "frivolous" lawsuit is? It sounds like it is still up to the judge, the only change is that now if he finds a lawsuit to be frivolous he has to punish them. But then wouldn't this discourage frivolous lawsuits? If the idea is that a judge might abuse this to dismiss legit lawsuits as frivolous..couldn't he have already done that anyways..since you say before this it was left up to the judges discretion?

The judge. It says it in the quote.

Yeah sorry see my edit.

It would discourage these kinds of lawsuits period. Why would a lawyer take the risk on this if they face potential harm and the financial benefit is uncertain. The idea isn't that judges would abuse this, its that now they're forced to punish lawyers simply for failing to meet their standard of proof. It's very draconian and obviously attempting to discourage lawyers from agreeing to represent people harmed by companies.

It also makes it very hard to do them at all, requiring that all were harmed equally in order to band together for a lawsuit. Meaning that more people would have to file them individually or in smaller numbers, putting greater financial pressure of them and limiting the evidence they can call upon. Which makes it easier to dismiss as frivolous.

It's disgustingly corrupt.

What would you suggest we do to combat frivolous lawsuits?

Nothing more needs to be done. It isn't a real problem.

You're cool with people suing over stubbed toes and such?

What specific penalty would you have for people who bring frivolous lawsuits?

Oh something simple like.....

Well that's disgusting. So many republicans in political power seem to be corporatists masquerading as populists, like Donald Trump.

Both political parties have such a cancer in them, they're in need of realignment.

Basically yeah. A libertarian Right and Classical liberal left would be the ideal political realignment.
