I actually feel this person didn't have the right to refuse. I feel a business should have the right to refuse service. This business is Uber and they don't allow discrimination. If they had a policy that allowed drivers to refuse certain passengers that would be different.
It also feels like they will have to fire this driver. Otherwise it seems like they are telling all the other uber drivers discrimination is okay.
iirc, and I almost always do:
1) Uber drivers are independent contractors
2) Uber does allow drivers to turn away some people, eg children/under 18 teens unaccompanied by adults
3) I believe Uber drivers can also turn away passengers with animals (service animals are the exception)
4) Overly intoxicated and/or drugged passengers can be turned away
5) Verbally abusive passengers can be turned away
So that private contractor does have the right it would seem, but Uber also has the right to terminate that contractor's employment if they do wish based on them turning away people.
