Newsmax Settles Defamation Suit Filed by Smartmatic

Smartmatic has reached a settlement with One America News Network over claims that the news outlet amplified false claims that the voting systems company rigged the results of the 2020 election."Smartmatic has resolved its litigation against OANN through a confidential settlement," said attorney Eric Connolly, who is representing the voting company in the lawsuit.
An attorney for OANN, Chip Babcock, did not immediately return a request for comment. The terms were not disclosed. Smartmatic still has lawsuits pending against Newsmax and Fox News.
The voting technology company Smartmatic and the conservative cable channel Newsmax have reached a settlement, averting a defamation trial that would have begun Monday over allegations that Newsmax personalities and guests spread lies about the 2020 election and Smartmatic's role in it.
Details of the confidential settlement were not released. The settlement came on the first day of the jury-selection process, with the trial expected to kick off next week. "Newsmax is pleased to announce it has resolved the litigation brought by Smartmatic through a confidential settlement," said a company spokesperson.
Smartmatic settled a similar lawsuit against the far-right One America News in April, also for an undisclosed sum. The company still has an ongoing lawsuit against Fox News, which could reach trial next year.

Fox News, News Max and One America News are all going to settle out of court for high millions because the damage of their internal messages getting out would be worse to them.
They all knew that the 2020 election wasn't stolen from the very top exec on down, yet spread the lies because of Trump and it's what their moron mouthbreather viewers wanted to hear.

A New York state appeals court rejected Fox's bid to dismiss a $2.7 billion defamation lawsuit by voting machine company Smartmatic over statements made on air after the 2020 U.S. presidential election on Thursday. The decision was issued by a five-judge panel of the Appellate Division in Manhattan.
Fox Corporation and Fox News Network were both named in the 2021 lawsuit, as were on-air personalities Lou Dobbs, Maria Bartiromo, Jeanine Pirro, frequent Fox commentator Rudy Guiliani, and attorney Sidney Powell, who was indicted along with Donald Trump in the Georgia election fraud case.

They'll be another SUPER high out of court settlement, imo, Fox News (the Murdocks) doesn't want the emails coming our where they admitted they knew the 2020 election wasn't stolen, that Trump is an immediate danger to the country and so much more related to that.
Dominion got nearly $1B out of them and Smartmatic is suing for nearly $3B. Hopefully, this bankrupts them, or gets them to stop shitting the airwaves.
Lindell Must Pay Smartmatic for Frivolous Suit

The Smartmatic voting machine company has filed a scathing defamation lawsuit against Donald Trump ally and MyPillow CEO Mike Lindell, alleging he concocted lies about a rigged presidential election to sell his products."Crazy like a fox. Mike Lindell knows exactly what he is doing, and it is dangerous," Smartmatic said in its lawsuit, filed Tuesday in U.S. District Court in Minnesota.
The suit, which also names the MyPillow company as a defendant, also alleges deceptive trade practices and seeks unspecified monetary damages. Dominion Vote Systems also sued Lindell last year for $1.3 billion in damages for the "enormous harm" it says Lindell created with his "viral disinformation campaign" about the presidential election.
The legal and financial woes for stalwart Donald Trump ally Mike Lindell continued to worsen on Monday, when a federal judge in Washington, D.C. ordered the MyPillow founder and CEO to cough up more than $50,000 in sanctions over frivolous claims he made in connection with his lawsuit against voting software company Smartmatic.
In the case, the underlying lawsuit was filed by Dominion Voting Systems, accusing Lindell and MyPillow of slander over false claims about the 2020 election. Lindell later sued both voting companies for alleged racketeering violations, among other claims, and lost. Smartmatic, in turn, moved for sanctions in the form of substantial legal fees.
In the end, Nichols, a Trump appointee, awarded Smartmatic $56,369; reasoning that the penalty should be based on Smartmatic's cost in defending against the frivolous claims.

Unfortunately it won't, they'll settle, take another massive hit to their fiances, but keep on shitting out obvious lies because their viewers are the same types of morons who think the WWE is real and that democrats stole an election while Trump was in power, but failed to steal it when Biden was in power. The most moronic of morons.

😂
Said it before, Lindell is Trump's most useful idiot. I'd feel sorry for him if he wasn't such a repugnant and reprehensible piece of shit.

Trump is about to serve his second term, and Lindell is still fighting lawsuits from four years ago. Sad.
Newsmax's Secret Smartmatic Settlement: $40 Million

When right-wing network Newsmax and Smartmatic agreed to settle the voting software firm's election defamation lawsuit last fall, the financial terms of the agreement were not disclosed and seemingly remained confidential. That is no longer the case.
In a regulatory filing released this week by Newsmax as part of its planned initial public offering, the channel revealed that it agreed to pay Smartmatic $40 million as well as issue a "five-year cash exercise warrant" for the voting machine firm to purchase 2,000 shares of preferred stock in the conservative cable channel.
The investment prospectus also noted that there was an inherent risk to investors due to the ongoing defamation case brought by Dominion Voting Systems, which is set to go to trial next month.

Right-wing cable channel Newsmax defamed Dominion Voting Systems by falsely reporting that the company was involved in rigging the 2020 presidential election, a Delaware judge ruled Wednesday.
Damages will be decided by a jury in a trial that will begin April 28th unless a settlement is reached. Dominion is seeking $1.6 billion. The ruling from Judge Eric B. Davis comes the week after Newsmax began trading as a public company.
Newsmax was among the channels presenting false claims by Trump's allies and supporters that Dominion, a provider of vote-counting machines and software, was created in Venezuela to rig elections for the late leader Hugo Chavez and that it has the ability to switch votes.
Lindell to Court: "I'm in Ruins"

In a court filing Thursday, the law firm of Parker Daniels Kibort, LLC said Lindell and MyPillow are months behind on their legal bills in three defamation cases, and they can no longer afford to represent him.“="At this time, Defendants are in arrears by millions of dollars to PDK," the filing said. "PDK is a small litigation and trial firm in Minneapolis, MN and cannot afford to finance Defendants' defense in the Litigations."
Lindell on Thursday praised his lawyers as "brave and courageous" and said he would gladly keep paying them, if he was not broke. "We've lost everything, every dime. All of it is gone."
In addition to the massive defamation lawsuits filed by Dominion and Smartmatic, Lindell is still battling the software engineer who won Lindell's $5 million "prove me wrong on voting machines" challenge. An arbitration panel ruled that Lindell must pay, but he has so far refused.
MyPillow CEO Mike Lindell told a federal judge Wednesday he has no money to pay thousands of dollars in sanctions imposed in one of the long-running lawsuits against him over his false election fraud claims.
During a court hearing, Lindell said he and his company face a combined $70 million in debt and ongoing garnishment by the IRS. "Nobody will borrow me any more. Not one dime," Lindell said. "I'm in ruins."
Last month, the voting systems company Smartmatic asked a federal judge in D.C. to hold Lindell in civil contempt over his failure to pay more than $50,000 in sanctions for filing a frivolous counterclaim in a defamation suit brought by a separate company, Dominion Voting Systems.
On Wednesday, he claimed he is now living off $1,000 a week because of what he described as a campaign of "lawfare" against him. "I don't have $5,000 or 5 cents," Lindell said.
Dominion Voting Systems Files $1.6 Billion Defamation Lawsuit Against Fox News
This lawsuit is definitely a major development in the ongoing conversation around media accountability. A $1.6 billion defamation suit is no small matter, and it raises important questions about the responsibilities of news outlets in reporting information, especially when it comes to claims that can seriously damage a company or individual’s reputation.
While Fox News has its loyal audience, this case could set a precedent for how media companies handle the spread of misinformation. I’m curious to see how this will unfold in the courts and what impact it might have on future reporting standards across the industry.

While I love this, it’s likely not entirely true, Lindell likely still has at least some millions squirreled away and Trump is asking the IRS to help him out now. They’ll probably declare he has absolutely nothing and then the courts will have to base their reward to the plaintiffs off of that IRS finding.
Sure it’s corruption at the highest level, but that’s the Trump admin.
