I think people should have the right to attack a criminal if they are on your property. Besides it's legal for a burglar to come into your house take anything and say, "hurt me and i'll sue" whats to stop them from doing it? Even if robbers steal things your not gonna get them back from the police.

Also how are you supposed to defend yourself without attacking someone?

No, you're only supposed to attack them if they attack you.

Screw that! if someone tries to take your life are you not gonna try and kill them to save your own? The law favours the criminal too much. A criminal can sue you if your not even in the house they are robbing, if they hurt themselves its your fault for having the furniture there for them to hurt themselves! its so freaking stupid.

I think that's a pretty silly law of England to have. You should be able to attack them first. If they try to kill you and you kill them in the process of defending yourself then they consider that your fault? That's screwed up.

Here in Florida the laws on all that are too loose in my opinion. Quite the opposite of England's law. You can kill anyone who trespasses in your house uninvited. Basically anyone who burglarises people's houses or apartments runs the risk of getting shot. In fact.. last Halloween a 6th grade boy was shot in the back and killed while playing "ding dong ditch" which is where you knock on someone's door then run away. The guy wasn't arrested right away.. I don't know if they eventually decided what he did was against the law or not. I think that's utter bullshit.. he should be locked up for good. Even if it was a burglar, what kind of prick shoots someone in the back running away from their house.

If some little shit breaks into your house with the intention of stealing all that you've worked your ass off for then you should have the right to kill him.

Yeah, you should be locked up for that. Unless they'd hurt someone in you're family... then I think you'd shoot them

I can just imagine the awkward silence.... a burglar taking stuff while some poor house owner just has to stand there and watch as he has not been attacked, maybe the burglar will even ask for help movie the heavier items....

Personally I think thats a law that should be changed, a person should be allowed to defend their home, and try to stop a burglary or home invasion, it just stands to reason that a citizen should make a citizens arrest, granted, killing them is extreme, but there are plenty of other ways to stop someone with out causing them to much harm.

Yea exactly well screw me if im going to stand there watching someone nick my stuff. Im not about to wait and see if that persons carrying a knife or a gun. I totally think the law should be changed - if i cant feel safe at home then where can i? IMO criminals go too far when they come into peoples homes. Mug me in the street, abuse me at wrk, but come into my house and i'll beat the living crap out of you.

No if someone attacks me in the street i'll defend myself and be pissed bout it the same at wrk - but at home i'd put them in hospital without thinking twice, before theyve even attacked me.

heres the full legal facts... if a person breaks into your home in the UK, he is guilty of the crime of breaking and entering... the householder is allowed to use reasonable force to evict such a person, after requesting that the person leaves... if the person picks anything up, that person is guilty of the crime of Burglary, which is an arrestable offence... now the householder is allowed to arrest that person, but only if the corect form is followed... that is, the arresting person must inform the criminal that he is being arrested, that the arrestee has the right to remain silent, but that it may harm his defence if he neglects to say something which he later uses in court, that anything he does say may be recorded and given as evidence... the arrestee must then be informed that the arrestor is authorised under the law to use reasonable force to restrain the offender until help arrives, or to deliver him into the hands of the authorities.... after all this, you can grab the guy and hold him.... the law has not been changed, just clarified... now, as before, a person is allowed to use reasonable force to defend his self , family and property.... so you don't have to watch people burgle you unless they attack... you can ask them to leave, and in certain cases restrain them... the bugbear of course is what counts as reasonable force...

plus, a couple of interesting legal points... if I walk through your open door, into your house, I have committed no crime... I am trespassing, but that is a civil offence, not a criminal one, and must be dealt with in a civil court.... if you attempt any of the above I can sue you... the minute i turn on alight, or use your toilet, I am guilty of Theft of amenities.... that is a crime...

if you're interested, an arrestable offence is any offence which can carry a five year custodial sentence.... such a sburglary.. theft... GBH... robbery... murder... arson and rape... and piracy on the high seas...

6 months ago somone broke into my house. my 2 kids were asleep and my wife was at work. i went out there and hit him in the gut with a ball bat. i had some handcuffs so i put him in cuffs then called the cops.

another strange legal thing... if you tell me you are going to hit me, and I believe you, even if you had no intention of hitting me, you are guilty of assault... if you hit me by surprise, you are not guilty of assault... assault must involve the threat or implied threat of violence.... you go into your bedroom, and think you can see someone in your bed...you stab the shape with your knife... then relief!! it was your pillow... you tell your friend, who is a policeman... it is his duty to arrest you for attempted murder!! whether anyone was there or not, you intended to kill someone, and for the charge intention is enough...
