no the prof could just check on lex everyday to see what he is up to so he can counter whatever it is or take control of lex's mind and have he to commit sucide.

Untrue. Lex has a year of time before Charles can act. Haven't you read the thread?
Lex has every advantage here, from the powersuit, to being able to develope powers, to having his own teams of heros, to having access to Godlike tech as well as whatever his own mind conjures.

Naah, Lex would find a way to counter Xavier's espionage. Moreover, I don't think they are allowed to have any surveillance on each other during the prep time...
