It's not stalemates. It's mostly that Black Adam doesn't have anything in the form of a low showing. Same with CM. This is pretty much the same reason why Sentry is in the top level.
I'm somewhat messing around with this idea but I can see an argument for why they should be up there and why they should stay put.
