How do you rationalize shooting a giant fireball at someone? You can't know with 100% certainty that someone is going to survive your attack, hence the dillema there. If you attack someone with a life ending attack then you might as well have killed them, as far as intent is concerned.
But even though the likely hood of their survival was not strictly 100%, given the players involved, it was certainly more likely than not that they'd survive. Which was sufficient enough for Itachi I suppose.

Oh yeah, I liked that line. Gave me the impression that Kishi was looking at the internet forums to see if anyone had gotten the right answer. We haven't, so now we have to work harder for it.
