Conspiracies need to be unlawful. PRISM is legal, hence why it sucks so bad.
Even under the very broad definitions or terrorism and suspects outlined in the Patriot Act, the activities of the NSA in this are still illegal. It's because they aren't gathering the information of suspects but instead gathering the information of everyone, everywhere.
Of course formal legality doesn't make something moral or not. Especially if the law legalizing said activity was approved in an illegal manner. Basically laws passed in a fashion outside of what the law allows.
It's so bad.
I find it amusing that the US is looking to charge this guy. So it's a crime to report crimes now?
