His flight sucks because he lacks the repulsor technology. And Steve can still throw his shield and cause the uni-beam to backfire on Norman.

That's how I imagined the fight would play out... Osborn launches an aerial assault, Cap forced to go on the defensive while gradually taking damage. As soon as he begins to throw his shield, he becomes vulnerable, and there is that chance Osborn would dodge the shield altogether.

So what do we have here?

Osborn getting floored with a single shield throw. Cap easily evading and blocking his energy beams.

In some tie-in (I think it was Initiative) Steve even busted his helmet. Tbf, Cage was holding Osborn.

Truth is, in a CIS-free scenario Osborn would get the majority. But CIS is on by default rules.

There is also the full capacity rule, true, but "fighting to his best ability" doesn't mean much when we're talking about Iron Patriot. Let's face it, Osborn is not some great fighter. And he's a very mediocre im suit pilot. Has he even beaten anyone? Because I honestly can't remember.
