Because the Ultimate Nullifier is an aspect of Galactus; it isnt his tech...
Its as much apart of him as your arms and legs are to you...as a result he should be able to call upon it whenever he wants to...but because of PIS, he hardly ever does so.
But here in a forum fight, PIS isnt allowed...right? So without PIS, there are very very very few beings that can beat him...and Supergod Herc sure as hell aint one of them.

"No PIS" doesn't make characters fight the way you want them to as if it were a battlezone. Simply put Galactus hasn't used the UN nearly enough to say its a viable tactic in a forum match where the possession of it isn't mentioned.
