I'm not using circular logic, I'm using what the comic clearly showed and that was Odin standing over Thanos at the end of the fight.

That wasn't the end of the fight. The end of the fight is when Odin decided to quit the fight. If you want to get technical Odin forfeited their battle so Thanos won.

Odin stopped fighting without a winner therefore Thanos won via technicality. I stand by it ended in a standstill but if you want to go to the letter of the law the man who backs down first loses then Thanos wins.
