Nonsense, he'd not last more than 10 or so days without water in ideal conditions. So at the most he had to look forward to was about 6 more days of a dehydrating torturous death.

I think money will do a bit more to make amends. Sometimes, money does help to heal wounds (in my extremely lay opinion on confinement psychology).

Personally I'd give up the money entirely if I thought my case could force someone important out of their position because of this kind of negligence. Legal systems are supposed to present enough of a threat that the people in charge work to prevent this kind of thing. As it stands the DEA will absorb the cost of the settlement and change nothing about how they handle people they arrest.

I realize this wasn't deliberate but I believe people we give authority to should be treated that much more strictly by the law. If you accidentally locked a person in your basement for several days there would be a very serious investigation into how that happened.

Agreed on all accounts.

Also, if I were a DEA Agent and I locked a suspect in a cell for 4 days and neglected that person, I would expect to get fired and possibly be criminally prosecuted...or at least have a legitimate tort accusation brought up against me.

You could do both.
