Well, it is obviously harrassment of some form and has had several problems bop up because of it(from cyber-bullying to harrassment).
I've seen channels taken down for less, so yeah there's valid reasons to critique YouTube here(although I wouldn't call them homophobic, just feigning incompetence in order get more drama since they can milk it for money).

In the UK, they have an assault clause about meeting like force.
You're not allowed to beat down someone for throwing a milk shake at you.
If you do, you're going to jail.
However, if someone throws a milk shake at you, you can throw one right back.
